Introduction

Thank you for reviewing the Political Data Intelligence LLC (“PDI”, “us”, “we”, or “our”) Privacy Policy. This policy outlines our privacy practices applicable to our websites, third-party sites, and applications used by PDI.

In the course of regular business operations, PDI may gather and use information about individuals. This information can include customers, clients, or other people the organization has a relationship with or may need to contact. This Privacy Policy describes how personal data must be collected, handled, and stored to meet PDI's data protection standards and to comply with the law. This Privacy Policy is intended to clearly explain what we consider to be “personal data”, what we consider to be “anonymous data”, and how this information is collected, used, and disclosed by PDI.

From time to time, we may change this Privacy Policy. If we do, we will post an amended version on this webpage with a new “last updated” date. Please review this Privacy Policy periodically.

Scope

This Privacy Policy applies to individuals who access a PDI website and our mobile applications (collectively, “Site”) and any of our online and, where required, offline products and services (collectively, “Services”), as well as the individuals with whom we do not have a direct relationship but whose information we process in connection with the Services we provide to our customers and clients. It applies to all data that PDI holds relating to identifiable individuals.

Types of Data We Collect and Store

PDI provides voter data products and services to political organizations, SaaS subscription services, software applications, voter data files, and maintains the Site.

In the process of doing business and providing the Services, PDI collects and maintains information classified as both “Personal Data” and “Anonymous Data” using the following definitions:

  1. Personal Data – “Personal Data” means data that allows someone to identify or contact you, including, for example, your name, delivery address, telephone number, e-mail address, voter registration information we provide through use of the Services, as well as any other non-public information about you that is associated with or linked to any of the foregoing data. This may also include sensitive personal information, such as ethnicity, political affiliation, or veteran status.
  2. Anonymous Data – “Anonymous Data” means data that is NOT associated with or linked to your Personal Data; Anonymous Data does not, by itself, permit the identification of individual persons.

It is important to understand PDI stores and maintains Personal Data that has been collected or acquired through different methods, with different levels of detail and different ownership rights.

These methods include the following:

  1. PDI Client, System User, or Website Visitor Information (Client Data) – Individuals that use the Services or purchase data or services directly through a PDI account representative may be required to provide Personal Data for direct communication, processing a payment transaction, or creating a unique user account (such data, “Client Data”). This information may range from billing information to the user’s IP address. We collect and store Client Data to support PDI’s client /marketing communications, enhancement of client’s online experience, and to provide online security and system performance. PDI does NOT sell any Client Data to any third-party entities for monetary consideration.
  2. Information Submitted to the Site or While Using the Services – Users of the Services will frequently add or input Personal Data to our Site through data entry and bulk import functionality (such data, “Submitted Data”). The purpose of Submitted Data is to enhance the individual information for a voter or proprietary contact data. All information created and added to the Site by the user is exclusively owned by the contracted entity that provided payment for the data or software purchase or other Services. PDI does not sell or share in any form Submitted Data with any third parties.

Some organizations may desire to share data through the use of the Services with another PDI account used by another organization using our Services. The Services includes software that has data sharing functionality that utilizes a specific protocol requiring active consent from the organization sharing and receiving the data.

PDI sales or support team members are not authorized to provide any account information that could assist in the configuration of data sharing between two or more client organizations.

We maintain commercially reasonable security measures to protect the Personal Data we collect and store from loss, misuse, destruction, or unauthorized access. However, no security measure or modality of data transmission over the Internet is 100% secure. Although we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee absolute security.

The Site may contain links that will let you leave the Site and access another website. Linked websites are not under our control. We accept no responsibility or liability for these other websites.

Children’s Privacy

The Site and Services are not intended for children under 13 years of age. We do not knowingly collect, use, or disclose Personal Data from children under 13.

Notice to California Residents

The California Consumer Privacy Act as amended by the California Privacy Rights Act of 2020 (“CCPA”), requires that we provide California residents with a privacy policy that contains a comprehensive description of our online and offline practices regarding the collection, use, disclosure, sale, sharing, and retention of personal information and of the rights of California residents regarding their personal information. This section of the Privacy Policy is intended solely for, and is applicable only as to, California residents. If you are not a California resident, this section does not apply to you and you should not rely on it.

The CCPA defines “personal information” to mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California resident or household. Personal information does not include publicly available, deidentified or aggregated information or lawfully obtained, truthful information that is a matter of public concern. For purposes of this "Notice to California Residents" section we will refer to this information as “Personal Information.”

    We retain your Personal Information for as long as necessary to fulfill the purposes for which we collect it, such as to provide you with the service you have requested, and for the purpose of satisfying any legal, accounting, contractual, or reporting requirements that apply to us.

    1. Right to Opt Out of Sales or Sharing of Personal Information

    California residents have the right to opt out of “sales” or “sharing” of their personal information under the CCPA, including through an “opt-out preference signal”.

If you have enabled privacy controls on your browser (such as a plugin), we will also treat that as a valid request to opt out. Please see the “Opt-Out Preference Signals” section below for more information.

    We do not knowingly collect, sell, or share the Personal Information of minors under 16 years of age.

    2. Right to Limit Use and Disclosure of Sensitive Personal Information

    California residents have the right to limit our use or disclosure of their sensitive Personal Information for purposes other than those allowed by the CCPA and its regulations.

    (4) the categories of third parties to whom we disclosed that Personal Information (if applicable)

    (5) the specific pieces of Personal Information we collected about you.

    4. Right to Delete Personal Information

    You have the right to request that we delete any of your Personal Information that we collected from you, subject to certain exceptions.

    5. Right to Correct Inaccurate Personal Information

    You have the right to request that we correct any inaccurate Personal Information we maintain about you.

    6. Right to Non-Discrimination for Exercise of Privacy Rights

    We will not discriminate against you for exercising any of your rights the CCPA confers.

    8. Authorized Agents

    If you are submitting a request on behalf of a California resident, please submit the request through one of the designated methods discussed above. After submitting the request, and if the request is not subject to an exemption or exception, we will require additional information to verify your authority to act on behalf of the California resident.

    9. Verifying Your CCPA Request to Know, Delete, and/or Correct

    If we determine that your request is subject to an exemption or exception, we will notify you of our determination. Otherwise, we will comply with your request upon verification of your identity and, to the extent applicable, the identity of the California resident on whose behalf you are making such request.

    We will verify your identity either to a “reasonable degree of certainty” or a “reasonably high degree of certainty” depending on the sensitivity of the Personal Information and the risk of harm to you by unauthorized disclosure, deletion, or correction as applicable.

    To verify your identity, we ask that you provide us with the following information when you submit your request: (1) first name, (2) last name, and (3) phone number or email. We will use the above information to verify your identity. Depending on your type of request or the information requested by you, we may require additional information to verify your identity and fulfill your request.

    10. Opt-Out Preference Signals

    The Sites recognize the Global Privacy Control (“GPC”) signal. If you are using a browser setting or plug-in that sends an opt-out preference signal to each website you visit, we will treat that as a valid request to opt out. If you choose to use the GPC signal, you will need to turn it on for each supported browser or browser extension you use.

    11. California Do-Not-Track Disclosure

    California law also requires that we disclose how we respond to “do-not-track requests” from our users. Currently, our Sites recognize and process "Do Not Track" signals from browsers.

    12. Shine the Light Law

    If you are a California resident and have an established business relationship with us, California Civil Code § 1798.83 permits you to request information regarding the disclosure of your personal information by us to third parties for the third parties’ direct marketing purposes (as those terms are defined in that statute).
